Thank you for your interest in Persystems. Protecting your personal data is important to us. This privacy notice informs you about which data is processed when you visit this website and when you contact us, for what purpose this happens and which rights you have. The website can generally be used without providing any personal data.

2. Hosting and server log files

This website is hosted on servers of Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany. The servers are located in Germany. A data processing agreement according to Art. 28 GDPR is in place with Hetzner. Further information: https://www.hetzner.com/legal/privacy-policy.

Each time the website is accessed, the web server automatically records information transmitted by your browser and stores it in server log files: IP address, date and time of access, page or file requested, amount of data transferred, status of the request, browser type and version, operating system and the previously visited page (referrer). This data is not merged with other data sources. The processing is based on Art. 6(1)(f) GDPR; our legitimate interest lies in the technically error-free presentation, the security and the stability of the website. The log files are deleted after 14 days at the latest, unless a specific security incident requires longer retention.

3. Encryption

This website uses TLS encryption (HTTPS). Data transmitted between your browser and our server therefore cannot be read by third parties. You can recognize the encrypted connection by the lock symbol in the address bar of your browser.

4. Cookies

This website does not use cookies for analytics, tracking or advertising purposes and does not use any web analytics services. Only one technically necessary cookie (“pll_language”) is set, which stores the language you have chosen so that the website is displayed in that language. This cookie contains no personal data and is permitted without consent under § 25(2) no. 2 of the German TDDDG; the legal basis for the associated processing is Art. 6(1)(f) GDPR. You can delete or block cookies in your browser at any time.

5. Contact by email or phone

If you contact us by email or phone, we process the data you provide (e.g. name, company, email address, phone number and the content of your inquiry) in order to handle your inquiry and in case of follow-up questions.

The legal basis is Art. 6(1)(b) GDPR insofar as your inquiry is related to the initiation or performance of a contract, and otherwise Art. 6(1)(f) GDPR on the basis of our legitimate interest in answering inquiries. The data is deleted as soon as it is no longer required for processing and no statutory retention obligations (in particular under commercial and tax law) prevent deletion.

Our email mailboxes are hosted by netcup GmbH, Daimlerstraße 25, 76185 Karlsruhe, Germany; a data processing agreement is in place with netcup.

6. Embedded YouTube videos (click to load)

On individual pages we embed videos from our YouTube channel. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The videos are embedded in such a way that, when the page is loaded, only a locally stored preview image is shown and no connection to YouTube is established. Only when you click on the preview image or the play button is the video loaded from YouTube in privacy-enhanced mode (youtube-nocookie.com). In doing so, data – in particular your IP address – is transmitted to Google; Google may set cookies and, if you are signed in to your Google account, associate the usage with your account. A transfer to the USA cannot be ruled out; Google LLC is certified under the EU-US Data Privacy Framework.

The legal basis is your consent under Art. 6(1)(a) GDPR and § 25(1) TDDDG, which you give by clicking on the video and which you can revoke at any time with effect for the future by no longer playing the video. 7. Links to external services

Our website contains links to external websites, for example to Google Maps for route planning to our location. When you click such a link you leave our website; the respective provider is solely responsible for the data processing on the linked pages. No data is transmitted to these providers before you click.

8. Job applications

If you apply for a job with us, we process your application documents in order to carry out the application procedure on the basis of § 26 of the German Federal Data Protection Act (BDSG) and Art. 6(1)(b) GDPR. If no employment relationship is established, we delete the documents no later than six months after the procedure has been completed, unless you have consented to longer storage or statutory provisions require otherwise.

9. Disclosure of data

Your personal data is only passed on to third parties insofar as this is necessary to process your inquiry or to fulfill a contract, you have consented, or we are legally obliged to do so. The service providers named in this policy (Hetzner, netcup) process data exclusively on our behalf and according to our instructions.

10. Your rights

With regard to the personal data concerning you, you have the following rights vis-à-vis us: the right of access (Art. 15 GDPR), to rectification (Art. 16 GDPR), to erasure (Art. 17 GDPR), to restriction of processing (Art. 18 GDPR), to data portability (Art. 20 GDPR) and the right to withdraw consent at any time with effect for the future (Art. 7(3) GDPR).

Right to object: Insofar as we process your data on the basis of Art. 6(1)(f) GDPR, you have the right to object to the processing at any time on grounds relating to your particular situation (Art. 21 GDPR). We will then no longer process the data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims.

To exercise your rights, an informal message to info@persystems.org or to the postal address given above is sufficient.

You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The supervisory authority responsible for us is the Bavarian State Office for Data Protection Supervision (Bayerisches Landesamt für Datenschutzaufsicht, BayLDA), Promenade 18, 91522 Ansbach, Germany, www.lda.bayern.de.

11. Storage period

We store personal data only for as long as is necessary for the purposes stated or as required by statutory retention periods. Once the purpose no longer applies or the periods have expired, the data is deleted or – insofar as it is no longer needed for the performance of a contract but must be retained – restricted in its processing.

12. No automated decision-making

We do not use automated decision-making, including profiling, within the meaning of Art. 22 GDPR.

13. Changes to this privacy notice

We will adapt this privacy notice if the website, our processing operations or the legal requirements change. The version published on this page applies in each case.
